Resume Rascals

TERMS FOR BASIC PACKAGE

Upon submission of an order through this online site you as “Client” agree to the following:

Purpose: “Client” engages Resume Rascals to provide and perform Candidate Sourcing services described and defined as follows: Resume Rascals will present contact and background information (Candidate’s Information Sheets) of potential candidates sourced from various Internet resources for each individual position. Each position is described as an additional employee slot in one given location of the “Client” or any of their subsidiaries. Resume Rascals will review information on each potential candidate and submit only candidates matching the position criteria submitted by “Client”, no more than once a week for 30 consecutive days.

Performance: Resume Rascals shall perform stated services using due diligence, best efforts, and commercially reasonable judgment, but guarantees no specific outcome to “Client”.

Cooperation: “Client” shall designate a Contact Person to whom Resume Rascals communications shall be primarily channeled. “Client” will be solely responsible for initiating Resume Rascals Candidate Sourcing for a position through submission of the Order Form or requesting additional batches of resumes for the designated position from Resume Rascals.

Charges/ Payments: “Client” shall pay Resume Rascals a service fee in the amount of Five Hundred Seventy Five Dollars ($575.00) for one position for which “Client” engages Resume Rascals to perform the Candidate Sourcing Service regardless of the outcome. “Client” shall incur the charge on the first day that Resume Rascals service is to begin. Payments not received by the 30th day following the day the service begins may be subject to bear 1.5% monthly late charge. If Resume Rascals undertakes collection or enforcement efforts; “Client” shall be liable for all costs thereof, including attorney fees.

Term: The term of each Candidate Sourcing Assignment begins on the date initiated and continues until the 30th day following the date that Resume Rascals receives the Order Form. Resume Rascals guarantees the position from the hire date of an employee into the open position through the 90th day following such hire date.

Guarantee: If the candidate hired into a position Resume Rascals is assigned leaves within their first 90 days we will provide “Client” with 2 additional batches of resumes within a 3-week period from notification by “Client”. In order to utilize this Guarantee, “Client” must notify Resume Rascals via email of the name and start date of the candidate upon hire.

Indemnity: “Client” shall hold Resume Rascals harmless in and from all claims, liabilities, damages, and detriments not arising from Resume Rascals, actual negligence or malfeasance.

Miscellaneous: This agreement establishes an independent contractor relationship and contains the entire recitation of legal terms governing the relationship. Operational directions and requests shall not amend such terms, which may only be amended, in writing, by both parties. This agreement is binding on all successors of the parties. All provisions hereof are severable.

These terms are accepted by you as "Client" upon submission of an order via this online site.

TERMS FOR EXPANDED PACKAGE

Upon submission of an order through this online site you as “Client” agree to the following:

Performance: Resume Rascals shall perform stated services using due diligence, best efforts, and commercially reasonable judgment, but guarantees no specific outcome to “Client”.

Charges/ Payments: “Client” shall pay Resume Rascals a service fee in the amount of One Thousand Four Dollars ($1,400.00) for one position for which “Client” engages Resume Rascals to perform the Expanded Candidate Sourcing Service regardless of the outcome. “Client” shall incur the charge on the first day that Resume Rascals service is to begin. Payments not received by the 30th day following the day the service begins may be subject to bear 1.5% monthly late charge. If Resume Rascals undertakes collection or enforcement efforts; “Client” shall be liable for all costs thereof, including attorney fees.

Term: The term of each Candidate Sourcing Assignment begins on the date initiated and continues until the 45th day following the date that Resume Rascals receives the Order Form. Resume Rascals guarantees the position from the hire date of an employee into the open position through the 90th day following such hire date.

Guarantee: If the candidate hired into a position Resume Rascals is assigned leaves within their first 90 days we will provide “Client” with 2 additional batches of resumes within a 3-week period from notification by “Client ”as well as 2 additional candidate phone screens. In order to utilize this Guarantee, “Client” must notify Resume Rascals via email of the name and start date of the candidate upon hire.

Indemnity: “Client” shall hold Resume Rascals harmless in and from all claims, liabilities, damages, and detriments not arising from Resume Rascals, actual negligence or malfeasance.

These terms are accepted by you as "Client" upon submission of an order via this online site.

TERMS FOR QUICK SERVICE

Upon submission of an order through this online site you as "Client" agree to the following:

Purpose: "Client" engages Resume Rascals to provide and perform Candidate Sourcing services described and defined as follows: Resume Rascals will present contact and background information of potential candidates sourced from various Internet resources for an individual position. Each position is described as an additional employee slot in one given location of the "Client" or any of their subsidiaries. Resume Rascals will review information on each potential candidate and submit a minimum of 12 candidates matching the position information submitted by "Client".

Performance: Resume Rascals shall perform stated services using due diligence, best efforts, and commercially reasonable judgment, but guarantees no specific outcome to "Client".

Cooperation: "Client" shall designate a Contact Person to whom Resume Rascals communications shall be primarily channeled. "Client" will be solely responsible for initiating Resume Rascals Candidate Sourcing for a position through submission of the Order Form.

Charges/ Payments: "Client" shall pay Resume Rascals a service fee in the amount of One Hundred Ninety Five Dollars ($195.00) for one position for which "Client" engages Resume Rascals to perform the Candidate Sourcing Service regardless of the outcome. "Client" shall incur the charge on the first day that Resume Rascals service is to begin.

Indemnity: "Client" shall hold Resume Rascals harmless in and from all claims, liabilities, damages, and detriments not arising from Resume Rascals, actual negligence or malfeasance.
